Introduction
LUDA BLACK (Pty) Ltd (“LUDA BLACK”) built the Metropoint app. The services are provided at no cost and are intended for use as is.
By registering, installing, accessing, or using our app, services, features, software, or website, you agree to these terms. You should stop using all our services (including the website and app) if you do not agree with any of the terms. We may amend the terms from time to time, and the latest version of the terms applicable at the time of using the service will regulate your use of the service. If we make material amendments that will create obligations or risk for you, we will add a prominent notification on the website or app to indicate that the terms have been amended.
Interpretation and Definitions
Interpretation
The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or plural.
Definitions
- Account: A unique account created for You to access our Service or parts of our Service.
- Affiliate: An entity that controls, is controlled by, or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest, or other securities entitled to vote for the election of directors or other managing authority.

- Providing Bus Route Information: Our primary focus is to provide real-time updates and information on bus schedules and routes.
- Connecting Users: Through the app’s functionality, users can communicate and share information within a community.
- Third Parties: Metropoint may work with partners, service providers, and affiliated companies to help us provide ways for you to connect with their services. We use the information we receive from them to help operate, provide, and improve our services.
- Improvement: We analyse how you use Metropoint to enhance all aspects of our services.
- Safety and Security: We work to protect the safety and security of Metropoint by dealing with abusive behaviour and violations of these terms. We may develop automated systems to improve our ability to detect and remove such activity. If necessary, we will take appropriate action by removing such individuals or activities or contacting law enforcement.
- Global Access: To operate our global service, we may store and distribute content and information in data centres and systems around the world, including outside your country of residence.
About Our Services
- Registration: You must create a user account to register for our services through the app, providing accurate information, including your current mobile phone number or email, and inform us if you change it. You agree to receive text messages with codes to register for our services.
- Age Requirement: Metropoint can be used by individuals under 18, as school kids take the bus. We comply with applicable laws to protect the privacy of children.
- Devices and Software: You will need certain device requirements, software, and data connections to use our services. You consent to us sending you notifications via Metropoint as necessary to provide our services to you.
- Fees and Taxes: You are responsible for all carrier data plans, Internet fees, and other fees and taxes associated with your use of our services.
Acceptable Use of Our Services
- Our Terms and Privacy Policy: You may only use our services according to these terms, our policies, and applicable laws.
- Lawful Use: You must access and use our services only for lawful, authorized, and acceptable purposes.
- Harm to Metropoint or Users: You may not directly, indirectly, through automated or other means access, use, copy, adapt, modify, prepare derivative works based upon, distribute, license, sublicense, transfer, display, perform, or otherwise exploit our services in impermissible or unauthorized manners.
- Keeping Your Account and Information Secure: You are solely responsible for keeping your device and your Metropoint account safe and secure, and you must notify us promptly of any unauthorized use or security breach.
Licenses and Intellectual Property
- Our Intellectual Property: All the intellectual property included in the services, website, and app belongs to us or our licensors.
- Your Rights: Metropoint does not claim ownership of the information you submit for your Metropoint account or through our services. You must have the necessary authorization and right to share information that you submit for your Metropoint account or through our services.
- Your License: You have a limited, revocable, non-exclusive, and non-transferable license to use our services on these terms only.
Indemnity
If anyone brings a claim against us related to your actions, use of the services, information shared, or content on Metropoint, you indemnify and hold LUDA BLACK (including our shareholders, directors, and employees) harmless from all liabilities, damages, losses, and expenses.
Exclusion of Liability
We provide our services on an "as is" basis without any express or implied warranties. We do not guarantee that Metropoint will always function without disruptions, delays, or imperfections. You use our services at your own risk.
Availability and Termination of Our Services
- Availability: We may add or remove our services, features, functionalities, and the support of certain devices and platforms. Our services may be interrupted for maintenance, repairs, upgrades, or network or equipment failures. We may discontinue some or all of our services without notice.
- Termination: We may modify, suspend, or terminate your access to or use of our services anytime for any reason, such as if you violate our terms, create harm or risk for us, our users, or others, or for any other reason.
Third-Party Products or Services
We may allow third-party product and service suppliers to advertise products or services through our app. We are not the supplier of these products or services and do not take responsibility for their performance.
Account and Personal Information Deletion
You can request the deletion of your account and personal information by contacting us, subject to certain exceptions. Once we receive and confirm your request, we will delete your personal information from our records, unless an exception applies.
Other
Unless a mutually executed agreement between you and us states otherwise, these terms make up the entire agreement between you and us regarding Metropoint and our services.
